Qualified health plans offered by health care corporations through a state exchange under the Affordable Care Act shall not provide coverage for elective abortion.

Health care corporation plans offered outside a state exchange shall not provide elective abortion coverage except through an optional rider purchased with an additional premium paid by the purchaser.

Employers may purchase an optional rider for elective abortion coverage if the rider cost is not factored into employee premium contributions and employees receive notice that the coverage can be used by minor or dependent females without employee notice.

"Elective abortion" is defined as terminating a pregnancy for purposes other than increasing probability of live birth, preserving the woman's life or health, or removing a dead fetus; excludes contraceptives and medically necessary abortion to avert death.

The section applies to certificates issued or renewed after its effective date and does not apply to Medicaid benefits or create a right to abortion.
