House Bill 6281 Summary

• Amends Michigan Vehicle Code Section 625 to add a new subsection (14) creating an enhanced offense for persons with 3 or more prior DWI convictions who operate a vehicle with any bodily alcohol content, effective October 31, 2010.

• Establishes "any bodily alcohol content" as 0.02 grams or more per 100 milliliters of blood (or equivalent breath/urine measurements) for habitual offenders, lowered from the standard 0.08 grams threshold.

• Creates a misdemeanor offense with penalties of up to 93 days imprisonment, up to 360 hours community service, and/or fines up to $2,500.00 for violations of the habitual offender provision.

• Modifies alcohol content thresholds effective October 1, 2013, raising the standard adult DWI limit from 0.08 to 0.10 grams and creating a "super-aggravated" offense at 0.17 grams or more with enhanced penalties including up to 180 days imprisonment.
