Requires school districts, intermediate school districts, and public school academies to adopt and implement a rigorous, transparent, and fair performance evaluation system for all teachers and school administrators.

Mandates evaluations include student growth as a significant factor, measured by national, state, or local assessments and other objective criteria.

Requires evaluations to be conducted at least annually with timely and constructive feedback, and to inform decisions on teacher effectiveness, promotion, retention, professional development, tenure, certification, and removal of ineffective personnel.

Exempts school districts, public school academies, and intermediate school districts with collective bargaining agreements in effect as of January 4, 2010 from compliance until after expiration of those agreements if the agreements prevent compliance with the evaluation system requirements.
