Requires hospitals to establish seasonal influenza immunization policies by October 1, 2010 consistent with CDC and Advisory Committee on Immunization Practices guidelines.

Mandates hospitals identify patients 65 years and older (and other at-risk patients at discretion) and offer influenza vaccination to those admitted for 24 hours or more during influenza season (October 1 - March 1).

Requires hospitals to offer free on-site influenza vaccination to all hospital staff persons (employees, contractors, students, and volunteers with patient contact) and provide information about vaccination risks and benefits.

Allows hospital staff to decline vaccination if medically contraindicated, already vaccinated, religiously opposed, or if they submit a written declination statement confirming they received vaccination information.

Requires hospitals to maintain vaccination records for at least 3 years documenting vaccinations, medical contraindications, declinations, and adverse events; both sections 21529 and 21531 expire April 1, 2012.
