Modifies school assessment requirements for grades 1-5 to use nationally-recognized norm-referenced tests or locally-adopted assessments approved by the superintendent of public instruction, effective 2009-2010 school year for grades 1-2 only.

Allows school districts and public school academies to use the Michigan Literacy Progress Profile to assess literacy in grades 1-3 as part of compliance with elementary assessment requirements.

Requires schools not in compliance with assessment mandates or those failing to participate in the National Assessment of Educational Progress program to lose accreditation under section 1280.

Establishes the Michigan Educational Assessment Program (MEAP) to maintain statewide assessment of educational progress in reading, mathematics, language arts, science, and other subject areas for all public school pupils in grades 3-8 annually.

Superintendent of public instruction must select nationally recognized, commercially available assessment instruments for each subject and grade level by October 1, 2009, and ensure contractors meet quality standards, include student individual reports, and meet specific deadlines for test administration and result reporting.

Repeals 1970 PA 38 effective December 31, 2009.
