Requires school districts and public school academies to maintain an average class size of no more than 17 pupils per class in grades K-3, with no individual class exceeding 19 pupils, phased in over a five-year period beginning in 2009-2010.

For 2009-2010, applies only to school buildings where at least 50% of enrolled students in grades K-3 were eligible for free lunch in the preceding school year.

Gradually expands the requirement with lower free lunch eligibility thresholds: 35% for 2010-2011, 20% for 2011-2012, and 10% for 2012-2013.

Beginning in 2013-2014 and thereafter, applies the class size limits to all school districts and public school academies operating grades K-3, regardless of free lunch eligibility.

Defines free lunch eligibility based on the Richard B. Russell National School Lunch Act, with data reported to the department by October 31 and adjusted by December 31 of the preceding school year.
