School districts, intermediate school districts, and public school academies must adopt and implement a policy on pupils with serious food allergies by the beginning of the 2009-2010 school year.

The policy must be designed to limit exposure of pupils with food allergies to food allergens and ensure timely and adequate response to allergic reactions.

The Department of Education, in consultation with the Department of Community Health, must develop a model policy by May 1, 2009.

The model policy shall be made available to school districts, intermediate school districts, public school academies, and nonpublic schools for their use.
