Board must approve or disapprove assistance requests within 90 days; applicants may request reconsideration of denials or waiver of the 90-day deadline.

Beginning July 1, 2009, applicants for fund assistance must certify in writing that they will not knowingly hire or contract with businesses that knowingly employ individuals not authorized to work in the United States.

Beginning July 1, 2009, applicants must commit to hiring only Michigan residents for projects and economic development work, with exceptions only for federal law compliance requirements or key management/specialized personnel not available in-state.

Written agreements must include remedy provisions allowing fund revocation and repayment requirements if applicants violate the hiring and contracting requirements.

Board must file annual reports by February 1 detailing Michigan residents employed in new jobs, job creation numbers, specific exemptions granted with reasons, and other relevant information.
