Petition sponsors must submit constitutional amendment and legislation initiative petitions to the director of elections for review before circulating them for signatures.

The director of elections must verify petition compliance with formatting requirements and that any subject matter statement fairly reflects the proposal, then prepare a written report for the board of state canvassers.

The board of state canvassers must meet within 30 days to approve or reject the petition form; signatures dated before board approval are invalid.

If the board rejects the petition, it must specify deficiencies and the sponsor may resubmit a corrected version for reconsideration within 30 days.

If the board fails to meet or vote within 30 days, the petition sponsor may proceed with circulation; the petition form remains subject to board review during the final sufficiency canvass.
