Senate Bill 417 Summary

• Amends Michigan Vehicle Code Section 320a to reduce the time frame for recording traffic violations from 10 days to 5 days after receiving an abstract from the Secretary of State.

• Beginning October 31, 2010, adds a new violation category assigning 4 points for moving violations resulting in at-fault collisions with another vehicle, person, or object.

• Creates new Section 602b prohibiting individuals from using cellular telephone devices while operating a motor vehicle on highways or streets, defined as initiating calls, answering calls, or sending text/instant messages.

• Exempts cellular phone use for reporting emergencies, personal safety threats, crimes, or by law enforcement and emergency personnel carrying out official duties.

• Allows hands-free cellular telecommunications devices and makes violations civil infractions subject to a maximum fine of $100.00; enforcement limited to secondary action during stops for other violations.
