Recount petitions for offices or propositions must be filed with the clerk of the board of canvassers that originally conducted the canvass, except for school district elections.

For school district elections, recount petitions shall be filed with the clerk of the board of canvassers that certified the election result.

Recount petitions must be filed within 6 days after the original canvass is completed by the county, city, township, village, or district board of canvassers.

A copy of the recount petition must be filed with the secretary of state within 2 days of filing the original petition, unless the office or proposition is a city, ward, township, village, or district matter (in which case a copy must be transmitted to the county canvassers clerk within 24 hours if the recount fee is paid).

Effective date is April 22, 2010, conditional upon enactment of Senate Bill No. 129 and Senate Bill No. 130.
