Senate Bill 758 Summary

• Changes county drain commissioner election cycle from November 1976 and every fourth year thereafter to November 2008 and every fourth year thereafter.

• Allows county clerk and prosecuting attorney to jointly appoint a temporary replacement drain commissioner when the elected commissioner cannot perform duties and no deputy has been appointed; temporary replacement receives same duties, responsibilities, and compensation as the drain commissioner.

• Permits counties with populations under 12,000 to abolish the drain commissioner office by 2/3 county board vote and transfer powers to the county road commission board.

• Allows counties with populations between 12,000 and 35,000 to place abolition of the drain commissioner office on the ballot (with incumbent commissioner's written approval) and transfer powers to county road commissioners if voters approve.

• Authorizes county boards to combine drain commissioner, public works, and public improvement agency functions into a single elected public works commissioner position, or to rename the drain commissioner position to water resources commissioner when additional water-related duties are performed.
