SB 1011 Summary

• Expands landfill reporting requirements to include material recovery facilities, transfer stations, and other waste processing facilities that must annually report solid waste received to the state, county, and municipality, itemized by origin and including remaining disposal capacity for landfills.

• Prohibits landfills from accepting out-of-state solid waste unless it meets one of three conditions: (1) uniform type material with generator certificate, (2) processed through in-state material recovery facility with certificate confirming prohibited items removed, or (3) generated in a department-approved jurisdiction.

• Imposes a processing inspection fee of $5.00 per ton or $1.67 per cubic yard on facilities processing out-of-state waste, payable quarterly to fund inspections and enforcement under a new processing inspection account in the solid waste management fund.

• Requires the department to inspect facilities processing out-of-state waste as frequently as practical and order reprocessing or return of non-compliant waste to the state or country of origin at the transporter's expense.

• Allows counties with sufficient local disposal capacity within 150 miles to exempt themselves from new landfill siting requirements and interim siting mechanisms without departmental construction permits.
