MI SB1039

Amends the Insurance Code of 1956 to modify the definition of "small employer" to explicitly include professional employer organizations (PEOs).

Establishes that a PEO shall be considered the employer of all its covered employees, and all covered employees of multiple clients participating in a single PEO-sponsored health benefit plan are considered employees of that PEO.

Incorporates definitions of "client," "covered employee," and "professional employer organization" from the Michigan Professional Employer Organization Regulatory Act.

Does not take effect unless Senate Bill No. 95 or House Bill No. 1037 of the 95th Legislature is enacted into law (tie-bar provision).
