Contracts for intergovernmental transfers of functions and responsibilities must include a description of transferred functions, effective date, term of operation, and property/equipment transfer methods.

Transferred employees must receive seniority credits, sick leave, vacation, insurance, and pension credits based on their records from the acquired system, with pension/retirement system members retaining all existing rights and benefits.

Transferred employees cannot be placed in a worse position regarding worker's compensation, pension, seniority, wages, sick leave, vacation, health and welfare insurance, or other benefits until a new labor agreement is negotiated.

All existing and expired labor contracts with an acquired system must be assumed by the receiving political subdivision and remain in effect until a new labor agreement is negotiated.

Contracts must specify financing methods and amounts to be paid by each participating unit, and other necessary legal, financial, and administrative arrangements to execute the transfer.
