Applicants for certificates of need must demonstrate to the department that a proposed project will meet an unmet need in the proposed service area through credible documentation and compliance with applicable review standards.

When no applicable certificate of need review standards exist, applicants must demonstrate unmet need through credible documentation that the proposed project will be geographically accessible and efficiently and appropriately utilized given the project type and existing health care system.

The department must consider approved but not yet operational projects, projects under appeal, and projects pending final decision when determining compliance with unmet need requirements.

Applicants must demonstrate that the proposed project is the most efficient and effective method of meeting unmet need, meets financial requirements including least costly total annual operating costs and available funding, and complies with applicable operating and quality assurance standards.

For hospitals licensed under part 215 that relocate beds between geographic locations, applicants must submit evidence of adequate access to public transportation services, which may include a formal agreement with a public transit agency to provide services to the hospital.
