SB 1263 Summary

• Establishes the "Sexual Assault Victim's Rights Act" to create victim protections and require prompt collection and analysis of sexual assault evidence.

• Requires law enforcement agencies to collect, analyze, or cause to be analyzed all evidence in sexual assault cases timely to maximize the criminal limitation period.

• Grants sexual assault victims the right to be informed of DNA profile results, whether profiles have been entered into data banks, and matches to other DNA profiles (unless disclosure would impede ongoing investigation).

• Mandates law enforcement provide victims status updates on evidence processing upon request, notify victims if analysis will not occur within 6 months, and provide 60 days' written notice before destroying evidence.

• Requires all Michigan law enforcement agencies to annually report to the attorney general the number of untested sexual assault evidence kits in their possession (by year for the previous 5 years) and the total sexual assault offenses reported in their jurisdiction.
