• Department cannot authorize the same bottomland log removal area in more than one submerged log removal permit at any single time.

• Department may modify proposed bottomland log removal area boundaries to avoid overlaps with other active permits or adverse impacts to the environment, natural resources, riparian rights, and public trust.

• Each submerged log removal permit must include an approved removal plan and contain terms and conditions to protect environmental and natural resources.

• Permit expiration extends from January 1, 2013 to the expiration date of the required United States Army Corps of Engineers permit, but not later than January 1, 2023.

• Applicants must provide a $100,000 performance bond at least 10 days before beginning removal operations to ensure compliance with permit terms and conditions.

• Permits are not transferrable unless approved in writing by the department.

• Permittees may request early termination of permits in writing, which may include release from quarterly reporting and performance bond requirements.
