Exempts commercial and industrial electric customers from energy optimization charges if they file and implement a self-directed energy optimization plan with their electric provider.

Sets eligibility requirements based on annual peak demand: 2 megawatts per site or 10 megawatts aggregate (2009-2010); 1 megawatt per site or 5 megawatts aggregate (2011-2013); 1 megawatt aggregate (2014 and later).

Waives eligibility requirements for customers installing electric energy efficiency improvements under a property assessed clean energy (PACE) program.

Requires customers to submit annual reports documenting energy efficiency measures and resulting savings; allows the commission to impose penalties of 1-2 times the exempted charges if minimum energy savings goals are not met.

Directs the Public Service Commission to establish an approval process for energy optimization service companies by September 1, 2010, and requires the Department of Energy, Labor, and Economic Growth to maintain a list of approved companies.
