School districts, intermediate school districts, and public school academies must adopt and implement a rigorous, transparent, and fair performance evaluation system for all teachers and school administrators by September 1, 2011

Evaluation systems must measure student growth through national, state, or local assessments and other objective criteria, with student growth as a significant factor in multiple rating categories

Evaluations must be used to inform decisions on teacher and administrator effectiveness, promotion, retention, professional development, tenure or certification, and removal of ineffective personnel

Collective bargaining agreements in effect as of January 4, 2010 that prevent compliance are exempt until after their expiration

School districts must continue current principal evaluations through the 2010-2011 school year and report effectiveness labels to the state department at that time
