Senate Bill 1522 Summary

• Establishes no statute of limitations for indictments involving murder, conspiracy to commit murder, solicitation to commit murder, first-degree criminal sexual conduct, Michigan anti-terrorism violations, and certain felonies punishable by life imprisonment.

• Allows indictments for criminal sexual conduct violations (sections 145c, 520c, 520d, 520e, 520g) to be filed within 10 years of the offense or by the victim's twenty-first birthday, whichever is later.

• Permits indictments based on unidentified DNA evidence to be filed at any time, but once the individual is identified, the indictment must be filed within 10 years of identification or by the victim's twenty-first birthday, whichever is later.

• Extends statute of limitations to 10 years for kidnapping, extortion, assault with intent to commit murder, attempted murder, manslaughter, and first-degree home invasion.

• Establishes a 10-year statute of limitations for indictments involving false pretenses, forgery, or mortgage fraud affecting real property, measured from the offense date or when the instrument is recorded, whichever is later.

• Sets a 6-year statute of limitations for identity theft crimes and all other indictments not otherwise specified.
