Department of Environmental Quality must use a fair and equitable sampling process to select operations and facilities for inspection.

Exemptions from fair sampling requirement include inspections based on third-party complaints, evidence of violations, follow-up inspections, permit issuance inspections, and inspections required by state or federal law.

Department must provide advance notice to inspected persons explaining their rights and responsibilities and the reasons for the inspection.

Department must offer inspected persons an opportunity to provide feedback on the quality of the inspection and inspector professionalism.

Department shall submit an annual report to the legislature on compliance methods, number of sampled inspections, and number of exempted inspections performed during the prior year.
