Children must be at least 5 years old on the first day of enrollment to attend school districts that do not provide kindergarten.

Kindergarten enrollment age requirement shifts progressively: December 1 cutoff until 2013-2014 school year, November 1 for 2013-2014, October 1 for 2014-2015, and September 1 beginning in 2015-2016 school year.

Parents or legal guardians may enroll children who will turn 5 by December 1 of the school year by submitting written notice to the school district by June 1 (or August 1 if moving after June 1), with final enrollment decision retained by the parent regardless of school district recommendations.

School districts and public school academies must notify the state department by December 31 of each school year of the number of children enrolled under the parental discretion provision.

Act takes effect only if Senate Bill 316 or House Bill 4514 of the 96th Legislature is enacted into law.
