Road authorities shall pay railroads annual maintenance fees for active traffic control devices at railroad-highway grade crossings, with fees ranging from $1,269.00 to $2,398.00 depending on signal type and track configuration.

Installation and modernization costs for active traffic control devices at public grade crossings shall be shared equally between railroads and road authorities.

Railroads are responsible for all maintenance, enhancement, renewal, and replacement of active traffic control devices after initial installation, except for the specified annual payments from road authorities.

The Michigan Department of Transportation must conduct a cost study every 10 years beginning January 1, 2010 to review maintenance costs for active traffic control devices and consult with railroad and road authority representatives.

Active traffic control devices must operate for 20 to 60 seconds before a train reaches the nearest curb line and continue operating until the train passes the far side of the highway.
