Establishes a statewide unused prescription drug repository and distribution program allowing eligible facilities and manufacturers to donate unused prescription drugs (excluding controlled substances) to pharmacies and charitable clinics for dispensing to eligible participants.

Limits eligible participants to Michigan residents who are on Medicaid/Medicare or uninsured individuals lacking reasonable means to purchase prescription drugs, as defined in administrative rules.

Restricts accepted drugs to those in original sealed, tamper-evident packaging that are not expired, controlled substances, or drugs requiring FDA manufacturer registration; participation by facilities, manufacturers, pharmacies, and clinics is voluntary.

Provides immunity from criminal and civil liability (except for gross negligence or bad faith) to the board, department, donors, pharmacies, charitable clinics, health professionals, and manufacturers involved in the program's lawful operation.

Requires the Department of Health and Human Services, in consultation with the Michigan Board of Pharmacy, to promulgate emergency rules within 6 months and permanent rules thereafter establishing eligibility criteria, drug acceptance standards, storage and dispensing procedures, and drug destruction protocols; effectiveness contingent on enactment of House Bill 5090.
