HB 5354 Summary

• Amends Section 54 of the Michigan Campaign Finance Act (MCL 169.254) to add references to sections 55b and 55d regarding contribution and expenditure restrictions.

• Prohibits corporations, joint stock companies, domestic dependent sovereigns, and labor organizations from making contributions or expenditures, except for exceptions in subsections (2) and (3) and sections 55, 55b, and 55d.

• Allows corporations, joint stock companies, domestic dependent sovereigns, and labor organizations to make unlimited independent expenditures for ballot question qualification, passage, or defeat, and to contribute to ballot question committees subject to the act.

• Establishes criminal penalties for knowing violations: individuals face fines up to $5,000 and imprisonment up to 3 years; non-individuals face fines up to $10,000.

• Bill effectiveness is contingent on enactment of companion legislation including House Bills 5348 and 5352, with blank references to additional Senate or House bills numbered in the 01994-01997 request series.
