MI HB5395

Amends the Public Health Code to redirect 5% of forfeiture proceeds collected under drug forfeiture laws to the state treasurer beginning October 1, 2012, for deposit into the domestic reimbursement utilization grant fund.

Requires courts to distribute remaining forfeiture proceeds (after expenses) to seizing agencies, with provisions allowing agencies to direct funds to nonprofits assisting law enforcement with drug-related investigations.

Permits state and local governments to donate forfeited grow lights and scales to elementary schools, secondary schools, or institutions of higher education that submit written requests, distributed in order of receipt.

Requires annual reporting by local units of government to the office of drug agencies detailing forfeiture proceedings, proceeds, property inventories (real property by type, vehicles, money, and personal property), and how funds were used for law enforcement.

Takes effect October 1, 2012, contingent upon the enactment of HB 5394 and HB 5396 in the same legislative session.
