Retailers must electronically submit sales information for ephedrine and pseudoephedrine products to the National Precursor Log Exchange (NPLEx) administered by NADDI before completing sales, effective January 1, 2012, with no fees charged to retailers.

Beginning October 1, 2012, NADDI must pay 5 cents per transaction submitted to NPLEx and forward collected funds monthly to the state treasurer for deposit into the domestic reimbursement utilization grant fund.

Retailers experiencing system failure may maintain written logs or alternative electronic records until able to resume electronic tracking compliance.

The NPLEx system must generate stop sale alerts when purchases would exceed quantity limits and provide an override function for dispensers with reasonable fear of imminent bodily harm.

Violation of record-keeping or sales verification requirements is a misdemeanor punishable by a fine of up to $500, and failure to comply does not create civil liability absent direct and proximate cause.
