HB 5403 Summary

• Requires individuals 18 years or older convicted of animal abuse offenses (defined as violations of MCL 750.49, 750.50, 750.50a, 750.50b, 750.50c, or similar offenses) to register with local law enforcement within 5 days of sentencing or 5 days after release from incarceration.

• Applies to individuals domiciled or residing in Michigan for 14 or more consecutive days, working in the state for 14 or more consecutive days, or present for 30 or more total days in a calendar year; also applies to out-of-state individuals convicted of comparable animal abuse offenses.

• Establishes $50.00 registration fee ($35 to state, $15 to local law enforcement), with provisions for waiver if registrant is indigent; creates animal abuse offenders registration fund for database maintenance and training.

• Requires registered individuals to verify their residence annually (January 1-15 for misdemeanor convictions, quarterly for felony convictions) and notify law enforcement within 5 days of any address changes; registration requirements last 5 years after initial registration or release from incarceration, whichever is later.

• Establishes penalties of up to 93 days imprisonment and/or $1,000 fine for willful violations; allows public access to compiled registration information indexed by zip code through law enforcement agencies and online database; maintains confidentiality of original registrations except for law enforcement purposes.
