Cemetery owners or operators may terminate burial, columbarium, or entombment rights to a space if 50 years have elapsed since the last recorded contact with the customer and proper notice requirements are met.

Cemetery must send written notice by certified mail with return receipt to the last known address of the space owner or representative listed in cemetery records.

If no response is received within 60 days of the certified notice, the cemetery must publish notice in a newspaper of general circulation in the owner's county.

Ownership rights are terminated 60 days after newspaper publication if no written response is received from the owner or representative.

If the owner contacts the cemetery after termination, they may request reinstatement at no cost if the space has not been resold, or receive the current retail value or a comparable space if it has been resold.

All contracts entered after the effective date must include written notice of the cemetery's right to terminate ownership rights under this section.
