Amends Michigan's sentencing guidelines (1927 PA 175, MCL 777.16aa) to add felonies related to electronic communications and surveillance violations to the sentencing guidelines framework.

Adds Class H felony offense for eavesdropping (MCL 750.539c) with a 2-year statutory maximum sentence.

Adds Class H felony for lewd surveillance or capturing lewd images (MCL 750.539j) with a 2-year statutory maximum, and Class E for subsequent offenses with a 5-year maximum.

Modifies sentencing provisions for damaging or obstructing use of electronic communications (MCL 750.540(6)) to include unauthorized tracking of a person's location, with penalties ranging from 2 to 4 years depending on whether injury or death results.

Bill is contingent on enactment of Senate Bill No. ____ or House Bill No. 5449 of the 96th Legislature.
