HB-5479 Summary

• Prohibits companies with direct investments in or contracts with state sponsors of terror (including Iran) from bidding on public contracts with Michigan state agencies, schools, cities, counties, and other public entities.

• Requires all bidders on public contract requests to certify they are not "state sponsor of terror linked businesses," with exemptions for social development companies.

• Imposes penalties for false certification including contract termination, 3-year bidding ineligibility, and civil fines up to $250,000 or twice the contract value, whichever is greater.

• Requires public entities to report false certifications to the Michigan Attorney General, who may pursue civil action and recover investigation costs and attorney fees.

• Allows companies to regain eligibility if they cease activities linking them to sanctioned states or if the U.S. government removes sanctions against the associated state sponsor of terror.
