Allows nursing home patients to apply for medical assistance with retroactive coverage of up to 3 months before the application date if they meet specific conditions.

Requires that in the 3 months preceding application, the applicant's excess assets do not exceed the amount allowed to be sheltered in an irrevocable prepaid funeral contract.

Permits applicants to use excess assets to purchase a funeral contract for themselves, their spouse, or both in order to become eligible for medical assistance.

Directs the Department of Human Services or Department of Community Health to immediately apply for any required federal waivers or state plan amendments needed to implement this provision upon enactment.
