HB 5733 Summary

• Removes language requiring electric utilities to provide retail customer choice of electric suppliers and eliminates the "customer choice and" portion from the act's title, leaving it as the "Electricity Reliability Act."

• Establishes that existing customers remain with their current electric utility for generation service and are ineligible to switch to alternative suppliers; customers who became customers after the bill's effective date must receive standard tariff service from the utility.

• Allows customers already receiving service from alternative electric suppliers on the effective date to continue or switch back to utility service, but if they switch back, they become ineligible to use alternative suppliers again.

• Permits customers who continuously used alternative suppliers since April 1, 2008 to expand usage and serve new similar facilities they own over 50%, and allows iron ore mining or processing facilities in Michigan's Upper Peninsula unlimited access to alternative suppliers.

• Maintains licensing requirements for alternative electric suppliers, code of conduct provisions, protections against unauthorized supplier switching, and allowances for self-service power generation and affiliate wheeling without transition fees.
