Removes the January 1, 2007 effective date requirement, making ballast tank flushing regulations for oceangoing vessels apply immediately rather than at a future date.

Allows oceangoing vessels to obtain permits for port operations if they demonstrate one or more of the following: complete flushing of ballast tanks with sea water at least 200 nautical miles from shore in waters deeper than 2,000 meters, commitment not to discharge aquatic nuisance species, or use of environmentally sound technology to prevent discharge of aquatic nuisance species.

Changes permit language from a single condition ("that") to allow demonstration of any one or more alternative compliance methods ("1 or more of the following").

Maintains the requirement that the department assess permit fees according to section 3120 and must issue permits according to established timelines.

Authorizes the department to promulgate rules implementing the oceangoing vessel permit requirements.
