Commission shall establish rates and conditions allowing all retail customers to choose alternative electric suppliers, with no more than 10% of a utility's average weather-adjusted retail sales permitted to switch at any time.

Customers continuously served by alternative suppliers since April 1, 2008, and iron ore mining/processing facilities in Michigan's Upper Peninsula may purchase electricity from alternative suppliers without the 10% cap restriction.

Customers who refuse advanced meter installation may purchase from alternative suppliers without restriction, and alternative suppliers may install non-advanced meters with standards established by the commission.

Alternative electric suppliers must obtain a license, maintain an in-state office, demonstrate financial and technical capabilities, maintain required records, and post a bond of at least $40,000 if determined to be in the public interest.

Only investor-owned, cooperative, or municipal electric utilities may own or operate electric distribution facilities and meter equipment; self-service power providers and affiliate wheeling operations are exempt from this restriction.
