Secretary of State may issue enhanced driver licenses or enhanced official state personal identification cards to applicants who provide proof of citizenship, identity, date of birth, social security number, residence address, and photographic identity document.

Enhanced licenses and identification cards must include reasonable security measures to protect personal information and may include radio frequency identification (RFID) technology limited to an encrypted randomly assigned number without biometric data.

Applicants must sign a declaration acknowledging their understanding of the RFID technology before receiving an enhanced license or identification card.

Prohibits intentionally obtaining, reading, or accessing encrypted data from enhanced licenses or identification cards without the cardholder's knowledge and consent, and prohibits selling, distributing, or possessing such data known to be obtained illegally.

Violators of the data access restrictions are guilty of a felony punishable by imprisonment for not more than 4 years or a fine of not more than $5,000, or both.
