When a county executive office becomes vacant due to resignation or death, the presiding or senior probate judge, county clerk, and prosecuting attorney jointly appoint a successor to fill the vacancy.

An appointed successor holds office for the remainder of the unexpired term until a successor is elected and qualified.

If more than 182 days remain before the next general election and it is not the scheduled general November election for that office, the appointed successor serves only until a successor is elected at the next general November election.

A newly elected county executive chosen to fill a vacancy serves a term equal to the balance remaining of the original term for which the previous county executive was elected.
