House Bill 6075 Summary

• Extends the notice requirement for change of ownership in nursing homes and homes for the aged from 15 days to 60 days before the change occurs.

• Prohibits licenses issued under parts 213 and 217 from being transferable to new owners and makes licenses subject to revocation upon verification of any ownership transfer without proper application and approval.

• Requires new owners of nursing homes to meet with department representatives and obtain a determination of noncompliance items before ownership change; department must not issue license to new owner until all deficiencies are corrected or approved plan of correction is in place.

• Increases the penalty for violating ownership disclosure requirements from $1,000 to $10,000 per violation.

• Adds criterion that department may refuse to issue nursing home license if applicant or person with ownership interest has unpaid debt or assessment to Internal Revenue Service within past 5 years, or unpaid wage and benefit determination under Michigan law.
