Amends section 1280c of the Public School Code to exempt schools from state intervention if the school district has an emergency manager in place under the local government and school district fiscal accountability act.

Superintendent of public instruction shall not issue orders placing schools under the state school reform/redesign officer's supervision if the school's district operates under an emergency manager.

The exemption applies to schools identified as among the lowest achieving 5% of public schools under the federal Race to the Top grant program.

Act takes effect only if House Bill 4214 of the 96th Legislature is enacted into law.

Approved by the Governor and filed March 16, 2011, with an effective date of March 16, 2011.
