Establishes two tiers of penalties for notary public violations under 2003 PA 238, with misdemeanor violations punishable by a fine of up to $5,000 or imprisonment up to 1 year, or both.

Elevates violations to felony status when a person knowingly violates the act while notarizing documents relating to real property interests or mortgage transactions, punishable by a fine of up to $5,000 or imprisonment up to 4 years, or both.

Requires actions concerning fees charged for notarial acts to be filed in the district court where the notarial act occurred.

Clarifies that penalties and remedies under the act are cumulative and that bringing an action or prosecution does not bar prosecution under other applicable laws.

Effective date: January 1, 2012.
