Removes the upper age limit of 18 years for students in sexual conduct crimes involving school employees, expanding the prohibition to students of any age attending public or nonpublic schools.

Criminal sexual conduct in the third degree applies when a school employee engages in sexual penetration with a student at the school where the employee works, regardless of the student's age.

Criminal sexual conduct in the fourth degree applies when a school employee engages in sexual contact with a student at the school where the employee works, regardless of the student's age.

Eliminates the emancipation exception that previously allowed conduct between school employees and emancipated students.

Takes effect July 1, 2012.
