SB-1209 Summary

• Amends the sentencing guidelines under Michigan's Code of Criminal Procedure to modify Offense Variable 10 (exploitation of a vulnerable victim) by expanding the definition of "predatory conduct."

• Expands "predatory conduct" to include preoffense conduct directed at a law enforcement officer posing as a potential victim, in addition to actual victims.

• Adds clarifying definitions for key terms: "exploit" means to manipulate a victim for selfish or unethical purposes; "vulnerability" means readily apparent susceptibility to injury, restraint, persuasion, or temptation; "abuse of authority status" means exploiting a victim out of fear or deference to authority figures.

• Clarifies that the mere existence of vulnerability factors does not automatically equate with victim vulnerability, requiring case-by-case evaluation.

• Takes effect March 1, 2013.
