SB 1367 Summary

• Amends the Metropolitan Extension Telecommunications Rights-of-Way Oversight Act to rename the "metropolitan extension telecommunications rights-of-way oversight authority" to the "areas metropolitan authority" created under the Michigan Metropolitan Areas Metropolitan Authority Act.

• Transfers the authority from the Department of Consumer and Industry Services to the Department of Licensing and Regulatory Affairs effective October 1, 2013.

• Grants the authority exclusive power to assess fees on telecommunication providers owning facilities in public rights-of-way within metropolitan areas to recover costs of right-of-way usage.

• Adds definitions for "broadband internet access transport services" (200+ kilobits per second) and expands the definition of "telecommunication provider" to include cable operators, broadband providers, internet service providers, and entities owning telecommunications facilities in public rights-of-way.

• Establishes transition procedures for transferring all powers, duties, records, property, and unexpended funds from the former authority to the new authority, with all existing rules and agreements continuing until revised or repealed.
