HB 4104 Summary

• Amends Michigan's concealed weapons law to prohibit licensed individuals from carrying concealed pistols or electro-muscular disruption devices on premises of schools, child care centers, sports arenas, bars/taverns, places of worship, entertainment facilities with 2,500+ seating capacity, hospitals, college dormitories/classrooms, and public libraries.

• Exempts parents or legal guardians from the school property restriction when dropping off or picking up students in a vehicle, and allows bar/tavern owners and employees to carry concealed weapons despite the prohibition for patrons.

• Provides exemptions from firearm restrictions for retired police officers, security personnel employed by restricted facilities, private investigators, corrections officers, state police officers, sheriff's posse members, auxiliary/reserve officers, probation/parole officers, and state court judges.

• Prohibits intentional display or open carrying of pistols on restricted premises beginning May 1, 2013, unless the individual owns the premises, is employed for security, or has written consent from the owner.

• Establishes penalties including state civil infraction with $500 fine and 6-month license suspension for first violation; misdemeanor with $1,000 fine and license revocation for second violation; and felony with up to 4 years imprisonment and/or $5,000 fine for third or subsequent violations.
