Governmental entities may charge a tap-in fee for connecting a structure to an available public sanitary sewer system, but only within a 2-year deadline after the latest of three triggering events.

The 2-year deadline begins from whichever occurs last: publication of notice of sewer system availability in a local newspaper, approval of a building permit for the structure, or approval of a permit to modify a structure to generate sanitary sewage.

If a governmental entity fails to charge the tap-in fee within the 2-year window, it is permanently prohibited from charging the property owner for that fee.

"Governmental entity" is defined to include cities, villages, townships, and authorities.
