Prohibits the department from issuing permits in disparate impact areas unless cumulative pollution levels and effects have been considered, and permits may be denied or conditioned based on cumulative pollution impacts.

Defines "likely disparate impact area" as a zip code containing 35 or more active permits under the air quality permit program.

Defines "cumulative pollution levels and effects" to include past and current environmental pollution from all sources and media within the geographic area where air emissions will deposit, plus effects on the environment and residents.
