Department of Licensing and Regulation shall promulgate definitions, codes, and rules for safe installation, repair, maintenance, use, operation, and inspection of carnival-amusement rides based on generally accepted engineering standards.

Director shall administer and enforce the act and all codes and rules regarding carnival-amusement rides.

Operators must obtain a permit from the director by March 1 each year; rides must be inspected before initial operation and at least annually thereafter.

Director may order temporary cessation of operation for any ride found to be hazardous or unsafe, with operation resuming only after corrections are made.

Director may modify application of rules when practical difficulties or unnecessary hardships exist for operators, provided the spirit of the rules is observed and public safety is secured; all modifications must be documented in a public record.
