HB-5095 Summary

• Establishes registration requirements with the state department of agriculture and rural development for animal control shelters, animal protection shelters, and large-scale dog breeding kennels (defined as facilities housing more than 15 intact female dogs over 4 months old).

• Prohibits pet shops, animal shelters, and large-scale dog breeding kennels from importing, selling, or adopting dogs and cats less than 8 weeks old, and requires vaccination against specified diseases and parasite treatment before importing animals into Michigan.

• Requires animal control shelters and animal protection shelters to observe holding periods (7 days for animals with owner identification, 4 days for those without) before disposition, and mandates spay/neuter contracts for adopted animals at least 6 months old, with minimum $25 good-faith deposits forfeitable if adoption terms are breached.

• Requires all regulated facilities to maintain detailed records for at least 2 years documenting animal acquisition, identification, disposition, and ownership transfer, and mandates annual reporting to the department of statistics on animal intake, adoption, and euthanasia.

• Limits large-scale dog breeding kennels to a maximum of 50 intact female dogs over 4 months old at any single physical location, and applies existing Michigan administrative code breeding standards with exception allowing female dogs in estrus to be housed with intact males for breeding purposes.
