HB-5104 Summary

• Amends Michigan's medical marihuana act to define "marihuana-infused product" as topical formulations, tinctures, beverages, edible substances, or similar products containing usable marihuana for human consumption other than smoking, and exempts these products from food law regulation.

• Establishes equivalency conversions for marihuana-infused products: 1 ounce of usable marihuana equals 16 ounces of solid form, 7 grams of gaseous form, or 72 fluid ounces of liquid form products.

• Requires marihuana-infused products to be individually packaged and labeled with weight, manufacturer name, manufacture date, and transaction details when obtained from caregivers or provisioning centers.

• Prohibits qualifying patients and registered caregivers from transferring marihuana-infused products to unauthorized individuals and establishes felony penalties (up to 2 years imprisonment or $2,000 fine) for violations.

• Allows registered patients and caregivers to manufacture marihuana-infused products for personal or caregiver use, and permits medical marihuana provisioning centers to manufacture these products subject to applicable regulations.
